These terms and conditions (“Terms”) govern the issuance and use of the Kristine Fox Gift Card (“Gift Card”). Gift Cards can be purchased in our stores or online from our website.

When you purchase a physical Gift Card in-store, your receipt of the Gift Card and payment at checkout establish a binding agreement between you and Kristine Fox, incorporating these Terms (“Agreement”).

If you purchase a digital Gift Card from our website, we will ask you to confirm that you accept these Terms before completing your purchase. Once confirmed, we will send you an order confirmation, which finalizes the binding Agreement.

These Terms apply exclusively to consumers purchasing or using Kristine Fox Gift Cards. Your purchase and use of a Gift Card are subject to the Terms in place at the time of purchase. The most current version of these Terms is published on our website.

1. General Information About Your Gift Card

1.1 This Agreement is between:

(a) The individual purchasing or using the Gift Card (“you” or “your”); and

(b) Kristine Fox Holding B.V. (“Kristine Fox,” “we,” “us,” or “our”).

1.2 Where Can You Use Your Gift Card?
Gift Cards can be used to pay for purchases at:

  • KristineFox.com
  • Kristine Fox full-price and outlet stores
  • Gift Cards cannot be used in third-party retail stores or franchises.

Check our Store Locator to find eligible locations that accept Gift Cards.

1.3 Geographic Use Restrictions

  • Gift Cards can only be used in the country where they were purchased.
  • If you buy a digital Gift Card on the French website, it can only be used on the French website or in selected French stores.
  • Additional geographic restrictions may apply due to regulations, which will be communicated before purchase.

1.4 Gift Card Balance & Limits

  • The balance on the Gift Card is stored in the local currency of the country of purchase.
  • A single Gift Card has a maximum balance, which will be displayed during the purchase process.
  • To protect against fraud, we limit the total Gift Card amount per transaction.

2. Validity and Use of Your Gift Card

2.1 Gift Card Details
Physical Gift Cards:

  • Require the barcode/number and PIN for transactions.
  • Digital Gift Cards: Are delivered via email and contain a unique barcode, number, and PIN.

2.2 Gifting a Gift Card

  • Physical Gift Cards can be given by simply handing them over.
  • Digital Gift Cards can be gifted by forwarding the email to the recipient.
  • Important: Always confirm that the recipient received the digital Gift Card before deleting your copy.

2.3 Expiration Policy

  • Your Gift Card does not expire.
  • However, we reserve the right to cancel a transaction or revoke a Gift Card under specific circumstances (see Section 6).

2.4 Checking Your Balance

  • You can check your Gift Card balance at any time.
  • Visit our Gift Card FAQ for instructions.

2.5 How to Use Your Gift Card

  • In-store: Present the barcode to a store associate and enter your PIN.
  • Online: Enter the Gift Card number and PIN at checkout.

If your Gift Card balance is insufficient, you must provide an additional payment method to complete the purchase.

3. Right of Withdrawal (for Digital Gift Cards)

3.1 Can You Cancel a Gift Card Purchase?

  • You may withdraw from your purchase of a digital Gift Card within 14 days, as long as it has not been used.

3.2 Refund Process

  • Refunds will be credited back to your original payment method within 14 days of receiving your withdrawal request.

3.3 Physical Gift Cards & Gifts

  • Physical Gift Cards purchased in stores cannot be refunded.
  • If you received a Gift Card as a gift, this withdrawal policy does not apply.

4. Refunds for Purchases Made with a Gift Card

4.1 How Refunds Work

  • If you return a product paid with a Gift Card, the refund will be credited back to the original Gift Card.
  • If multiple Gift Cards were used, we will allocate refunds accordingly or issue a new Gift Card with the refund amount.

4.2 Partial Refunds (for Online Purchases)

  • If an order was paid with multiple payment methods, refunds will be split proportionally.

Example:

  • €200 purchase: €100 from a Gift Card + €100 from a credit card.
  • If €100 worth of items are returned:
    €50 is refunded to the Gift Card.
    €50 is refunded to the credit card.
    For in-store returns, the Gift Card portion will be refunded first.

5. Lost or Stolen Gift Cards

  • You are responsible for keeping your Gift Card details safe.
  • We do not replace lost or stolen Gift Cards.
  • If your Gift Card is lost or stolen, you can request to revoke it with proof of purchase, provided it has not been used.

6. Cancellation and Revocation Rights

Kristine Fox reserves the right to:

  • Cancel a transaction if fraud or unauthorized use is suspected.
  • Revoke a Gift Card if it was purchased fraudulently or used in violation of these Terms.

If we cancel or revoke a Gift Card, we will notify you via email or during the purchase process.

7. Term and Termination

  • This Agreement remains valid indefinitely until:
  1. The Gift Card balance is fully used, or
  2. Kristine Fox revokes the Gift Card (as outlined in Section 6)

8. Liability

  •  Kristine Fox is not liable for losses due to:
  • Unauthorized transactions if you fail to safeguard your Gift Card details.
  • Compliance with legal obligations affecting Gift Card use.

11. Governing Law and Dispute Resolution

  • This Agreement is governed by the laws of the Netherlands, excluding the Vienna Convention on the International Sale of Goods.
  • Disputes will be settled in the Amsterdam courts unless you are a resident of another EU country, where you may file a claim under local consumer protection laws.

12. Online Dispute Resolution (ODR)

  • You can access the Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr.
  • Please note that Kristine Fox does not currently participate in online dispute resolution through third-party platforms.
