1. With Which Entity Are You Entering Into an Agreement?
When you place an order through our Digital Points of Sale, the agreement is established between you and Kristine Fox Holding B.V. located at Beech Avenue 54, 1119 PW, Amsterdam, The Netherlands, registered with the Dutch Chamber of Commerce under number 73081353, tax number NL859346912B01 , hereinafter referred to as “we,” “us,” or “our.”

2. When Can You Place an Order?
You may place an order if:

You are using our Digital Points of Sale as a guest with a valid personal email address or as a registered account holder;
You are a consumer (non-business buyer) purchasing items in quantities suitable for personal use;
You are 18 years or older, or you have obtained permission from a parent or legal guardian and are legally eligible to enter into an agreement.

3. How Can You Place an Order?
Orders can be placed exclusively through our Digital Points of Sale and are available for delivery. The shipping destination must match the country in which the order was placed.

Please note that our offers on the Digital Points of Sale are non-binding, meaning we reserve the right to withdraw an offer after an order has been placed if, for example, the product is out of stock.

To complete your purchase, follow all steps in the online ordering process and select “Place Order.”

After placing an order, you will receive an Order Confirmation via email, which will include:

4. When Does the Agreement Come Into Existence?
The agreement between you and Kristine Fox is formed once you have placed your order and received an Order Confirmation from us.

5. Can You Cancel or Modify Your Order Before It Has Been Delivered?
If you have placed an order by mistake or wish to cancel before it is delivered, please contact our Customer Service immediately. We will do our best to assist you, but since we prioritize fast deliveries, cancellations are only possible before the Shipping Confirmation is sent.

Once your order has been shipped, cancellations will no longer be possible. However, your right to withdrawal, as outlined in Section 12, remains unaffected.

Please note that we cannot modify existing orders (e.g., address, size, or color changes). If changes are needed, you will need to cancel the entire order and place a new one.

6. Is It Possible That a Product You Ordered Is Out of Stock?
We strive to ensure all items displayed on our Digital Points of Sale are available for immediate purchase. However, in rare cases, an item may become unavailable after an order has been placed. If this occurs, we may withdraw our offer or cancel that portion of the order. Any payments made for unavailable products will be refunded.

Our inventory is regularly updated, but occasional discrepancies may occur. If a product is sold out, we encourage you to check back, as stock is frequently replenished. Additionally, you may use our Store Locator to check availability in physical Kristine Fox locations.

7. Can We Decline or Cancel Your Order?
We reserve the right to revoke our offer, decline, or cancel your order for any valid reason, including but not limited to:

The product is out of stock.

Your order is flagged as unusual or potentially fraudulent by our security systems.
If we reasonably suspect fraud.

You are purchasing as a reseller or for commercial purposes.
If applicable, your payment via bank transfer is not received within five business days after the order confirmation.
We are unable to deliver to the address you provided.
There are evident errors in the product details or pricing on our Digital Points of Sale.
Force majeure or other circumstances beyond our control prevent the fulfillment of the order.
If we cancel or decline your order, you may not receive a Shipping Confirmation. Any payments received related to the order will be refunded, and we will inform you via email with the reason for cancellation.

8. What Is the Price of Your Order?
The prices displayed on our Digital Points of Sale are in local currency and include VAT. The total amount shown at checkout includes taxes and any applicable shipping fees. This amount will be reflected in your Order Confirmation. If you pay by credit card, the total amount will appear on your bank statement.

Prices may change, but these changes will not affect any confirmed orders.

If we discover a pricing error on one or more items in your order, we will notify you as soon as possible. You will have the option to confirm your order at the correct price or cancel it. If you choose to cancel and have already paid, we will issue a full refund. We are not obligated to fulfill an order at an incorrect price unless:

You have already received an Order Confirmation, and
The incorrect price was reasonably perceived by you as correct.

9. How Can You Pay for Your Order?
We accept payment through credit card (MasterCard, Visa, American Express), PayPal, and other payment methods available on our Digital Points of Sale. You may also partially pay using a valid promotion code.

For orders with post-payment options (where applicable), payment must be made according to the timeframe set by the payment provider.

The maximum order amount may vary based on your payment method and whether you are a guest or registered user. More details are available on our website.

During payment, we may conduct credit checks. Based on these checks, we may adjust, refuse, or limit an order or a selected payment method. In such cases, alternative payment options may be offered. Our Customer Service does not have access to credit check results.

10. How Can You Use a Promotion Code?
Promotion codes are valid only for purchases made through our Digital Points of Sale and are limited to single-use transactions.

To apply a promotion code:

Enter your code in the “Enter Your Promo Code” field on the shopping bag page.
Click “Apply.”
Additional conditions may apply. Unless stated otherwise, promotion codes cannot be combined with other offers or discounts.

If you return an order, the discount from the promotion code will be proportionally split across the returned items. Promotion codes are non-refundable and cannot be reissued in case of full or partial returns.

11. When and How Do You Receive Your Products?
We aim to deliver orders within 2 to 5 business days after shipment. However, during promotional periods, delivery times may vary.

For more information on delivery times and rates, please visit our Delivery Information page. If, for any reason, we are unable to deliver your order on time, we will notify you, cancel your order, and issue a refund (if payment was already processed).

Delivery to an Address of Your Choice

During checkout, you can choose your preferred delivery address. Details about your chosen delivery method will be included in your Order Confirmation.

If products arrive with visible material or production defects, including damages from shipping, please contact our Customer Service immediately.

Once delivered to the address you provided, you assume responsibility for the products. The products remain our property until full payment is received.

Delivery to a Kristine Fox Store

If you choose to collect your order in-store, you will receive an email confirmation when your order is ready for pickup.

To collect your order:

Present your order number and valid ID to the store associate.
If someone else is picking up on your behalf, they must also present the order number.
A signature is required upon collection.

12. Can You Return the Products?
To be eligible for a return, products must be:

Unworn, unwashed, and in their original condition
Complete with all labels and tags intact
Not used beyond what is necessary to assess suitability
If the condition of returned items does not meet these requirements, we may deduct an amount corresponding to the depreciation in value.

Please do not return items from multiple orders in the same parcel to avoid delays in processing your refund.

The following items cannot be returned:

Personalized products
(Partially) used gift cards
Underwear, swimwear, perfumes, or makeup (unless in sealed original packaging)
Your Legal Right to Withdrawal

You have 14 calendar days from the date of receipt to withdraw from your purchase without providing a reason.

If your order contained multiple items delivered separately, the 14-day period begins when the last item is received.

To initiate a withdrawal, you must inform us via Customer Service. You may use our withdrawal form, but it is not mandatory.

Once we receive your withdrawal request:

We will refund all payments related to your order within 14 days, including shipping costs (if applicable).
Refunds will be processed using the same payment method as the original transaction.
Returns must be sent back using our provided return label.
If you fail to return the products within 14 days of your withdrawal request, we may withhold the refund.

Additional Return Policy (Beyond the Legal Withdrawal Period)
Beyond your 14-day legal withdrawal right, we offer an additional 46-day return period, allowing you to return products up to 60 days from the date of receipt.

This extended return period follows the same conditions as the legal withdrawal policy.

Returns Due to Defects
If your received product has material or manufacturing defects, including damage during transport, please contact Customer Service immediately.

You may return defective, incorrectly described, or non-conforming products within 6 months of receipt. If your claim is valid, we will issue a full refund, including shipping costs (if applicable).

Under Dutch and EU law, products must meet contractual agreements. You are entitled to several statutory rights if you report a defect within a reasonable timeframe. The limitation period for claims is two years after discovering the defect.

These rights are in addition to any other warranties or consumer protections applicable under local laws.

13. Can You Exchange Products?
It is not possible to exchange products. If you are not fully satisfied with your purchase, you can return the item and receive a refund, as described in these Conditions. If you would like a different product, color, or size, please place a new order.

14. What Law Applies to the Agreement Including These Conditions and Which Court Can I Go To?
This agreement, including these Conditions, is governed by the laws of the Netherlands, excluding the Vienna Convention on the International Sale of Goods. However, this choice of law does not deprive you of any protection provided by the mandatory laws of the country in which you reside, provided that Kristine Fox offers and sells products in that country.

The competent court in Amsterdam, the Netherlands, shall have non-exclusive jurisdiction over disputes relating to these Conditions. This means that you may bring a claim in Amsterdam, or alternatively, in a court within your jurisdiction that enforces consumer protection laws.

If Kristine Fox initiates legal proceedings against you in Amsterdam, you have the right to inform us in writing within one month that you prefer the dispute to be resolved by a court in your country of residence.

For online disputes, the Online Dispute Resolution (ODR) platform is available at http://ec.europa.eu/odr. Please note that Kristine Fox does not currently participate in an online dispute resolution procedure before a dispute resolution body.
